What is Section 138?

Section 138 makes cheque dishonour a criminal offence when the cheque was issued for a legally enforceable debt or liability.

Conditions for Filing a Case 

The cheque must be issued for repayment of debt or liability.The cheque must be presented within its validity period.The bank must return the cheque unpaid.A legal notice must be sent within 30 days of receiving the bank memo.The drawer must fail to pay within 15 days of receiving the notice.
